MY BACKGROUND

Over 40 Years Of Experience Representing Private And Public Sector Clients Regarding Cable Television, Wireless, Wireline, Public Utility And Energy Regulatory And Transactional Matters

For over 40 years, I have represented public and private sector clients regarding cable, energy/public utility, wireline and wireless telecommunications administrative litigation, regulatory and transactional matters. At the beginning of my legal career, I served as a law clerk to Justice Edmund V. Keville at the Massachusetts Appeals Court and as a full-time Instructor of Legal Research and Writing at Boston College Law School (as well as the player-coach of a Law School basketball team known as the TJ Hoopers). For five years, I served as an Assistant Attorney General and Chief of the Utilities Division of the Massachusetts Office of the Attorney General as a representative of consumer interests in public utility and telephone company rate cases, financing applications and other proceedings.  In private practice, I have represented investor-owned and municipal utilities, cable operators and a cable trade association, competitive local exchange carriers, wireless service providers and state and local governmental entities. I also served for twelve years as a part-time Assistant City Solicitor for the City of Newton, Massachusetts.

MY CURRENT PRACTICE

I am admitted to practice in Massachusetts and Rhode Island and am a member of the  bars of the United States District Court of Massachusetts and the United States Court of Appeals for the Frist Circuit. My current practice emphasizes the representation of public sector clients and organizations, advice on federal requirements applicable to municipal permitting of wireline and wireless infrastructure, advice on specific wireless permit applications. drafting local policies and regulations for permitting wireless facilities to be located in public ways, license agreements for attachments to municipal poles and leases for wireless use of municipal property. I am available to represent clients regarding cable matters and assist in monitoring a range of federal and state telecommunications  regulatory matters. I am familiar with data center issues which are impacting municipalities and their residents.  I am resident in Pennsylvania and frequently use Zoom to attend public hearings and meetings. With client consent, I have worked through a co-counsel agreement with an  experienced attorney who is resident in Massachusetts.

Work Hightlights

  • Supervised and handled as lead counsel public utility rate cases, financings, investigations and rulemakings on behalf of the Massachusetts Office of the Attorney General
  • Counsel of record for the Massachusetts Office of the Attorney General in Maryland v. Louisiana, 451 U.S. 725 (1981) (involving First Use Tax on gas from the Outer Continental Shelf)
  • Transactional and regulatory representation of a Massachusetts city regarding a municipal fiber network project using utility conduit
